These Website Terms and Conditions apply to your access to and use of the Alpha Motorsport AU website and services.
1. About these Terms
These Website Terms and Conditions (Terms) apply to your access to and use of the Alpha Motorsport AU website, customer and dealer accounts, order request services, bookings, coaching and training information, Ask Alpha, and any future account tools made available through www.alphamotorsport.com.au.
In these Terms, “Alpha Motorsport”, “we”, “us” and “our” mean Alpha Motorsport AU. “You” and “your” mean any person who accesses or uses our website or services.
By using the website, creating an account, submitting an order request, making a booking or using Ask Alpha, you agree to these Terms and acknowledge our Privacy Policy. These Terms operate together with our Shipping & Dispatch Policy and Refunds & Cancellations Policy.
2. Eligibility and accounts
You must provide accurate, current and complete information when creating or using an account. You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account. You must notify us promptly if you suspect unauthorised access or misuse.
Dealer access and dealer pricing are available only to approved dealer accounts. We may reasonably suspend, restrict or terminate access where necessary to protect users, systems or our business, to investigate misuse, or where these Terms have been breached.
3. Website information and availability
We take reasonable steps to keep product, price, availability, image, specification, event and technical information accurate and current. However, information may change and may not always be complete or error-free.
Website access may be interrupted for maintenance, security, faults or circumstances outside our reasonable control. Third-party links are provided for convenience only. We do not control and are not responsible for third-party content, availability, security or privacy practices.
4. Products, pricing and order requests
Submitting an order request does not complete a sale, reserve stock or guarantee availability. We may confirm stock, compatibility, quantities, pricing, shipping and other details before accepting an order.
A sale is formed when we accept the order and issue or confirm the applicable invoice or payment request, subject to any additional terms communicated to you.
Prices are in Australian dollars and include GST unless stated otherwise. Shipping and other applicable charges may be added. Dealer pricing applies only to eligible products and approved dealers. Some products may be supplied at retail price where no dealer discount is available.
Stock is not allocated, packed or dispatched until cleared payment is received unless otherwise agreed in writing. You are responsible for checking product suitability for the intended kart, engine, class, rules and application.
5. Payments, invoices, delivery and collection
Payments, invoices and payment links may be provided through third-party accounting and payment providers. You must provide accurate billing, shipping and contact information.
Delivery and collection are governed by our Shipping & Dispatch Policy. Refunds and cancellations are governed by our Refunds & Cancellations Policy and applicable law.
6. Bookings, coaching, training and events
Availability, eligibility, inclusions, pricing, venue requirements and cancellation arrangements may vary. Participants and parents or guardians must provide relevant information and comply with organiser, venue and safety requirements.
Motorsport involves inherent risks. Nothing in these Terms excludes rights or obligations that cannot lawfully be excluded.
7. Ask Alpha and user submissions
Eligible retail and dealer account holders may submit questions for review through Ask Alpha. Only Alpha Motorsport may provide an official answer through Ask Alpha. Submission does not guarantee an answer, response time or publication.
Ask Alpha submissions are treated as private when received. Alpha Motorsport may review, moderate, edit, paraphrase, combine, categorise, de-identify, answer, decline, archive, remove or publish a submission in accordance with these Terms and our Privacy Policy.
By submitting a question, you grant Alpha Motorsport a non-exclusive, worldwide, royalty-free licence to store, reproduce, edit, adapt, de-identify, publish and communicate the question and our answer for the purposes of operating Ask Alpha, providing support, and developing educational or technical resources.
We will not intentionally publish your name, email address, account details, order number or other identifying information as part of a public Q&A. You must not submit passwords, payment data, confidential or sensitive information, another person’s personal information, or unlawful, defamatory, abusive, misleading or infringing material.
Questions may include supporting files or HTTPS links. Retail and dealer submitters may include up to five files, with a maximum size of 2 MB per file. Alpha administrators may include up to five response files, with a maximum size of 10 MB per file. Accepted formats may be limited to common images, PDF, DOCX, XLSX, TXT and CSV, and may be changed or further restricted for security or operational reasons.
Submission files and links remain private from the public unless Alpha Motorsport separately selects or creates a resource for public release. Alpha response files and links identified as public may be accessible to anyone who can access the published Q&A.
You warrant that you have the right to upload or link to submitted material. You must not upload or link to malicious code, unlawful, infringing, defamatory, misleading, confidential, commercially sensitive or privacy-invasive material. We may inspect, decline, remove, disable or refuse to publish any file or link, and we do not guarantee that third-party links will remain safe, accurate or available.
We may correct, update or remove published content or supporting resources where an accuracy, privacy, safety, security, legal or operational concern is identified.
8. My Kart(s), Setup Tracker and sharing
If these features are made available, account holders may store kart, engine, component, setup, session, technical and related records. The person creating a record is responsible for its accuracy and for deciding whether it should be shared.
Kart and setup records are not accessible to other customers or dealers by default. Alpha Motorsport may access those records where reasonably necessary to operate and administer the platform, provide requested support, maintain security, troubleshoot technical issues, manage permissions, investigate misuse, improve the service or comply with applicable law.
A customer may grant an approved Alpha Motorsport dealer access to selected setup records. By sharing a record, the customer authorises Alpha Motorsport to make the selected information available to the named dealer for setup, technical, product or customer support.
Unless stated otherwise, dealer access is read-only. A dealer receiving access must use the information only for the customer-related purpose for which it was shared, keep it reasonably secure, not disclose or use it for unrelated purposes without authority, and stop accessing it when permission is withdrawn.
Customers may revoke future platform access. Revocation may not retrieve copies lawfully downloaded, printed or retained before withdrawal. Alpha Motorsport may suspend or remove sharing access for privacy, security, misuse, account suspension or legal compliance.
Private identifiable setup records will not be published or used for public benchmarking or marketing without additional permission. We may use genuinely de-identified and aggregated information to improve products, support and technical resources.
9. Technical information and motorsport safety
Website content, Ask Alpha answers and setup tools provide general information based on the details available. Suitability may vary according to model, specification, wear, installation, conditions, driver, rules and other circumstances.
You must inspect equipment, follow manufacturer instructions, comply with applicable rules and obtain suitably qualified assistance where necessary. Information provided through the website is not a substitute for physical inspection, professional work or advice specific to your circumstances.
10. Acceptable use
You must not:
- attempt unauthorised access to the website, another account or any connected system;
- interfere with security, availability or operation of the website;
- introduce malicious code or harmful material;
- impersonate another person or misrepresent your authority;
- misuse dealer pricing or account access;
- scrape, copy or extract substantial website content without permission; or
- use the website for unlawful, fraudulent or abusive activity.
11. Intellectual property
Unless stated otherwise, website content, branding, text, graphics, photographs, documents, forms, technical resources and software are owned by or licensed to Alpha Motorsport. You may use them for personal or internal business purposes connected with our products or services, but may not commercially reproduce, distribute or exploit them without our written permission.
12. Australian Consumer Law
Our goods and services come with consumer guarantees that cannot be excluded where the Australian Consumer Law applies. Nothing in these Terms excludes, restricts or modifies any non-excludable right, remedy, guarantee or liability.
13. Liability
To the maximum extent permitted by law, Alpha Motorsport is not liable for indirect or consequential loss arising from use of the website, interruption of access, or reliance on general information. Any lawful limitation applies only to the maximum extent permitted by law.
You remain responsible for decisions and actions taken using technical or setup information, including compatibility, installation, condition, safety and rules compliance.
14. Privacy
We handle personal information in accordance with our Privacy Policy. Ask Alpha submissions and any future kart or setup sharing functions are administered as described in that Policy.
15. Changes to these Terms
We may update these Terms prospectively by posting a revised version and updated date. Terms applying to an existing confirmed paid transaction will not be changed retrospectively unless required by law or agreed with you.
16. Governing law
These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of Victorian and Australian courts and tribunals.
