These Website Terms and Conditions apply when you use the Alpha Motorsport AU website, accounts, online resources and services.
1. About these Terms
These Terms apply when you use the Alpha Motorsport AU website, create or use an account, place an order request, make a booking, use Ask Alpha, access online resources or use another service we provide through www.alphamotorsport.com.au.
In these Terms, Alpha Motorsport, we, us and our mean Alpha Motorsport AU. You and your mean the person using our website or services.
By using our website or services, you agree to these Terms and acknowledge our Privacy Policy. Our Shipping & Dispatch Policy and Refunds & Cancellations Policy also apply where relevant.
2. Accounts and eligibility
You must provide accurate and current information. You are responsible for keeping your login details secure and for activity carried out through your account. Tell us promptly if you suspect unauthorised access.
Access to some prices, resources or features may depend on your account type, approval, eligibility or other conditions we tell you about. We may reasonably suspend, restrict or close access to protect users, our systems or our business, investigate misuse, comply with law or deal with a breach of these Terms.
3. Website information and availability
We take reasonable steps to keep product, price, availability, image, specification, event and technical information accurate. Information can change and may not always be complete or error-free.
The website or a feature may sometimes be unavailable because of maintenance, security, faults or events outside our control. Third-party links are provided for convenience. We do not control and are not responsible for third-party content, availability, security or privacy practices.
4. Products, prices and order requests
Submitting an order request does not complete a sale, reserve stock or guarantee availability. We may check stock, compatibility, quantity, price, shipping and other details before accepting an order.
A sale is formed when we accept the order and issue or confirm the relevant invoice or payment request, subject to any additional terms we give you.
Prices are in Australian dollars and include GST unless stated otherwise. Shipping and other applicable charges may be added. Dealer pricing is available only for eligible products and approved dealers. You are responsible for checking whether a product is suitable for the intended kart, engine, class, rules and use.
5. Payments, invoices, delivery and collection
Payments, invoices and payment links may be provided through third-party accounting and payment services. You must provide accurate billing, shipping and contact information.
Our Shipping & Dispatch Policy applies to delivery and collection. Our Refunds & Cancellations Policy and applicable law apply to refunds and cancellations.
6. Bookings, training and events
Availability, eligibility, inclusions, prices, venue requirements and cancellation arrangements may vary. Participants and parents or guardians must provide relevant information and follow organiser, venue and safety requirements.
Motorsport involves inherent risks. Nothing in these Terms excludes any right or obligation that cannot legally be excluded.
7. Ask Alpha and content you submit
Eligible account holders may submit questions through Ask Alpha. A submission does not guarantee an answer, response time or publication. We may review, edit, summarise, combine, categorise, de-identify, answer, decline, archive, remove or publish a submission in line with these Terms and our Privacy Policy.
By submitting content, you give us a non-exclusive, worldwide, royalty-free permission to store, copy, edit, adapt, de-identify, publish and communicate that content where reasonably necessary to operate Ask Alpha, provide support and develop educational or technical resources.
You must have the right to submit the content you provide. Do not submit passwords, payment information, unlawful or malicious material, confidential information, material that infringes someone else’s rights, or another person’s personal information without authority. We may inspect, decline, remove or disable content for legal, safety, security or operational reasons.
8. Online resources and account tools
We may provide online resources and account tools, including track maps, worksheets, forms, records, feedback tools and sharing features. Their availability, eligibility and functions may change over time.
Unless we clearly say otherwise, these resources are general information or training aids. Track maps and worksheets may be incomplete, simplified or out of date. They do not replace current circuit information, track inspection, coaching, safety instructions, venue requirements or advice for a particular driver or situation. You are responsible for checking current information and deciding whether and how to use a resource.
Access does not give you ownership. Unless we state otherwise, you may use resources only for your own personal or internal karting purposes. You must not sell, sublicense, republish, publicly distribute or commercially exploit them without our written permission.
We may add, update, correct, replace, suspend, remove or restrict resources or features. Asking for a resource or feature does not guarantee that it will be created, accepted, published or remain available.
You keep ownership of original content you create or upload. You give us permission to host, store, copy, process, display and communicate that content where reasonably necessary to provide and manage the service, support you, keep the service secure, improve it or comply with law.
You must have the right to enter, upload and share all content you provide. We may restrict or remove content that is unsafe, unlawful, malicious, misleading, confidential, privacy-invasive or infringes another person’s rights.
9. Sharing information
Private account information is not available to other customers or dealers by default. Where a feature allows sharing, you are responsible for choosing what to share, who to share it with and whether sharing is appropriate.
A person who receives shared information must use it only for the purpose for which it was shared, keep it reasonably secure and not disclose or use it for another purpose without authority.
You may withdraw future access through our system. This may not retrieve copies that were lawfully downloaded, printed or kept before access was withdrawn. We may suspend or remove sharing access for privacy, security, misuse, account suspension or legal reasons.
10. Free, trial and paid access
Some resources or features may be free, in beta, available for a trial or promotion, or offered for payment. Before you buy or enrol, we will tell you any material price, billing period, renewal arrangement, cancellation method and important access condition.
We will not automatically renew paid access unless the recurring arrangement is clearly disclosed and authorised. We may change future prices, inclusions or access arrangements, subject to applicable law and any notice or cancellation rights we tell you about.
When access ends, you may no longer be able to use the feature. This does not necessarily delete your account or records. Information is retained or deleted in line with our Privacy Policy. Nothing in this section limits rights that cannot legally be excluded.
11. Technical information and safety
Website content, technical resources, track maps, worksheets, Ask Alpha answers and account tools are based on the information available. Suitability can vary because of model, specification, wear, installation, circuit changes, conditions, driver, rules and other circumstances.
You must inspect equipment, follow manufacturer instructions, comply with applicable rules and obtain suitably qualified help where needed. Website information is not a substitute for physical inspection, professional work or advice specific to your circumstances.
12. Acceptable use
You must not:
- attempt to access another account or system without permission;
- interfere with the security, availability or operation of the website;
- introduce malicious code or harmful material;
- impersonate another person or misrepresent your authority;
- misuse dealer pricing, account access, secure links, resource permissions or paid access;
- share another user’s private information without authority;
- scrape, bulk-download, copy or extract substantial website or account content without permission; or
- use the website for unlawful, fraudulent, abusive or infringing activity.
13. Intellectual property
Unless stated otherwise, the website and its content, including our branding, text, graphics, photographs, track maps, worksheets, documents, forms, technical resources and software, are owned by or licensed to Alpha Motorsport. You may use them only as allowed by these Terms or other written terms we provide.
14. Australian Consumer Law
Our goods and services come with consumer guarantees that cannot be excluded where the Australian Consumer Law applies. Nothing in these Terms excludes, restricts or changes any right, remedy, guarantee or liability that cannot legally be excluded.
15. Liability
To the maximum extent permitted by law, Alpha Motorsport is not liable for indirect or consequential loss arising from use of the website, interruption or withdrawal of access, loss of user-created content, or reliance on general information or training resources. Any limitation applies only to the maximum extent permitted by law.
You remain responsible for decisions and actions taken using technical, setup, feedback or track-map information, including driving decisions, compatibility, installation, equipment condition, safety, venue requirements and rules compliance.
16. Privacy
We handle personal information in line with our Privacy Policy. We may also provide a specific notice where a feature handles personal information in a new or materially different way.
17. Changes to these Terms
We may update these Terms for future use by posting a revised version and updated date. We will not retrospectively change the terms applying to an existing confirmed paid transaction unless the law requires it or you agree.
18. Governing law
These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of Victorian and Australian courts and tribunals.
